§ 9-31. Proper maintenance required.

  • (a)

    All yards, swale areas, walkways, driveways, parking areas, vacant lots and landscape areas shall be properly maintained consistent with the following standards:

    (1)

    They shall be free of refuse and debris.

    (2)

    Vacant land which is no closer than three hundred (300) feet from a developed parcel shall not have grass or weed growth in excess of twelve (12) inches in height.

    (3)

    Lots or parcels either vacant or upon which structures are located or vacant land located within three hundred (300) feet of a developed parcel shall not have grass or weed growth in excess of six (6) inches in height.

    (4)

    All paved areas shall be maintained reasonably free of holes and cracks.

    (5)

    All landscape material shall be maintained reasonably free of weeds and foreign matter and shall be kept in reasonably healthy condition at all times. All dead material, including trees, shall be replaced consistent with the requirements of the landscape code.

    (b)

    The exteriors of all buildings and structures shall be maintained in a condition which is consistent with the following standards:

    (1)

    All portions of the building or structures shall be structurally sound so as not to present a danger to the community.

    (2)

    The exteriors of buildings and structures shall be painted at reasonable intervals such that large areas (greater than one (1) square foot) are not peeling or cracking.

    (3)

    All roofs shall be at least seventy-five (75) percent clear of mildew and other stains.

    (c)

    The owner of property within the city shall have the responsibility to maintain the swale area abutting his property and to keep the swale area free of refuse and debris. For the purposes of this section, a swale area is defined as that area immediately adjacent to the road between the driving surface of the road and the adjacent private property line.
