§ 15-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Capacity reservation fees means the fees charged by the city to reserve water and wastewater capacity corresponding to the proposed use. Each developer, builder, governmental entity or property owner requiring utilities services shall be required to make payments to the city in accordance with this chapter.

    City engineer means the appointed head of the engineering department of the city or his authorized representative.

    Connection charges means those charges of the city required to be paid by a consumer as a condition precedent to the interconnection of city's utility system with a consumer's property.

    Consumer means any person, firm, association, corporation, governmental agency or similar organization supplied with the availability of water, sewer or natural gas service by the city, including developers and large users, sometimes referred to as the "customer."

    Consumer installation means all pipes, fixtures, meters, appurtenances of any kind and nature used in connection with or forming a part of an installation for utilizing water, sewer or natural gas services for any purpose, located on the consumers' side of point of delivery, whether such installation is owned outright by a consumer or by contract, lease or otherwise.

    Contributors-in-aid-of-construction (CIAC) means the sum of money and/or property represented by the value of the water distribution and sewage collection facilities constructed by the consumer and conveyed to the city as an inducement to the city to provide service in accordance with the city's water and sewer extension policies set for in this chapter.

    Department means the planning and development department.

    Developer means any future consumer or entity developing property or converting existing developed property which requires utility service from the city.

    Easements means rights of ingress, egress, dedications, rights-of-way, conveyances or other property interests necessary or incidental to the installation, extension, repair, replacement, maintenance, construction or reconstruction of city's utility system or any components thereof, over or upon consumer's property.

    Finance director means the appointed head of the finance department of the city or his authorized representative.

    Main means pipe, conduit or other facility installed to convey water or sewer service from individual laterals or to other mains, including apparent facilities, and, when the context so requires, shall refer to gas transmission pipes of like character.

    Off-site facilities means those components of water distribution and sewage collection facilities and gas distribution facilities located outside consumer's property to connect with the then terminus of the existing facilities of the city.

    On-site facilities means those components of water distribution and sewage collection facilities and gas distribution facilities located upon consumer's property.

    Point of delivery means the point where the city mains are connected with the consumer installation. Unless otherwise indicated, the point of delivery for water and gas service shall be at the discharge side of the water or gas meter. Unless otherwise indicated, the point of delivery for sewer service shall be at the upstream connection of the cleanout which is placed at or about a public right-of-way or utility easement. In the absence of a cleanout, the point of delivery is at the sewer lateral connection to the sewer main of the city.

    Property means the land or improvements upon land of which the consumer is owner or over which consumer has control either by contract or possessory interest sufficient to authorize consumer to make application for service, or adjacent right-of-way which services the land or site being developed. The city shall require proof of such interest prior to the furnishing of service by copy of instrument of conveyance, contract or appropriate verified statement contained in the application for service.

    Rate schedule means the schedule or schedules of rates or charges for the particular classification of service.

    Service means, in addition to all gas, water and sewer utilities required by the consumer, the readiness and ability on the part of the city to furnish gas, water or sewer services to the consumer.

    Service availability charge means the charge to consumers for availability of service for any dwelling or commercial use as may be determined from time to time by the city and as presently set forth in the schedule of rates and charges in this chapter.

    Service or lateral lines means those pipes of the city that connect to consumer's installations.

    Utilities director means the appointed head of the utility department of the city or his authorized representative.

    Utility system means the city's water distribution and sewage collection system, and any component parts thereof, and the city's natural gas distribution system, and any component parts thereof, which systems are distinguished herein as the context determines.
