§ 12-3. Residential containers.

  • (a)

    Single-family residences. There shall be kept and maintained at all times in an appropriate place in or upon the premises of each single-family residence a sufficient number of garbage cans or garbage carts to accommodate all of the garbage and rubbish generated by the occupants of the single-family residence, in which same shall be placed and stored in order that such may be collected.

    (b)

    Multi-family dwellings. Each apartment, condominium, cooperative or other multi-family dwelling shall at all times maintain in an appropriate place a sufficient number of collection containers to accommodate all of the garbage, rubbish, and trash generated in such dwelling, in which same shall be placed and stored in order that such may be collected.

    (c)

    Size of containers. Collection Containers shall be of sufficient size to meet requirements for twice per week collection and be of watertight construction provided with a tight-fitting cover. Garbage cans for single-family residences shall have a capacity of not more than fifty (50) gallons. Garbage cans and garbage carts shall be placed at a curbside location that is easily accessible to the contractor, but never upon any street or sidewalk. No bulky waste, garbage can, or garbage cart may be placed at curbside earlier than 7:00 p.m. of the day preceding the scheduled collection day, and all garbage cans, garbage carts, recycling containers, and uncollected waste shall be removed from curbside no later than 7:00 p.m. on the scheduled collection day.

    (d)

    Inspection, condemnation as unfit. The code enforcement officer shall determine whether or not a resident of the city has a sufficient type, frequency, and level of service to ensure the timely and sanitary collection of the garbage, rubbish, and other solid waste generated by the resident. The code enforcement officer also shall have the power to inspect and approve collection containers and to condemn collection containers that are unfit, unsafe, unsightly, uncovered, unsanitary or otherwise pose a threat to the health of persons living within the city.
