§ 17-15. Minimum standards for basic equipment and facilities.

  • No person shall occupy, or let to another for occupancy, any dwelling or dwelling units, for the purpose of living, sleeping, cooking, or eating, which do not comply with the following requirements:

    (1)

    Every dwelling unit shall contain not less than a kitchen sink, lavatory, tub or shower and water closet, all in good working condition, and installed in accordance with the building code. The kitchen sink shall be at least twenty-two (22) inches by twenty-five (25) inches in size and provided with a one and one-half-inch drain with crumb strainer.

    (2)

    Every dwelling unit shall contain a room which affords privacy to a person within said room which is equipped with a flush water closet, lavatory basin and tub or shower in good working condition and properly connected to the city water system and sewer system.

    (3)

    Every kitchen sink, lavatory basin, and bathtub or shower required under the provisions of this section shall be properly connected with both hot and cold water lines with the exception of accessory bar sinks.

    (4)

    Every dwelling unit shall have water heating facilities which are properly installed, maintained in safe and good working condition, and properly connected with hot water lines required under the provisions of the preceding subsections. Such water heating facilities shall be capable of supplying on demand to all the required fixtures a continuous supply of hot water at a minimum temperature of one hundred ten (110) degrees Fahrenheit. The hot water heater provided shall have at least a twenty-gallon capacity and shall comply with the standards of the building code. A three-quarter-inch cold water control gate valve, as well as a temperature and pressure relief valve and a discharge drainage line terminating outside the building shall be supplied.

    (5)

    Every occupied dwelling unit shall be provided with an installed permanent cooking facility, shall be in good working order at the time of installation and shall have four (4) top burners and an oven. At least two (2) of the burners shall have controls independent of the oven. Every occupied dwelling unit shall be provided with an installed refrigerator. Vacant dwelling units shall be provided with utility connections for such facilities.

    (6)

    Every dwelling unit shall contain adequate cabinet and shelves for the storage of dishes, cooking utensils and food. A minimum six-foot kitchen cabinet base and top section complete with storage and center compartments shall be supplied.

    (7)

    Every dwelling unit shall contain adequate storage space for clothes and linens.

    (8)

    Meter rooms shall be clear of any debris and shall not be used for storage. If the manager resides on the premises, the meter room may be locked provided that a sign has been posted indicating where the key to the outlet room is kept at all hours.

    (9)

    All units shall have a fuse or circuit breaker panel board readily accessible to the inhabitants of the unit in accordance with the building code.

    (10)

    Owners of dwellings containing more than two (2) dwelling units shall provide lighting to on-site public areas and parking lots from one-half hour before sundown to one hour before sunrise. Such lighting shall have at least one and one-half foot candles of intensity in all areas required to be illuminated and shall be installed, positioned and maintained so as not to constitute a nuisance to adjoining properties. Lighting of on-site parking areas shall be provided as required by the land development code.

    (11)

    All bedroom units and bathrooms serving more than one bedroom shall be accessible by a hall or other approved area and not through a bedroom.

    (12)

    Hotels and motels shall not permit cooking appliances of any sort within their units except in approved kitchens or kitchenettes.

    (13)

    All elevators shall be maintained in a safe condition as required by F.S. Ch. 399.

    (14)

    Every supplied facility, piece of equipment, or utility required in this section shall be maintained in a safe and satisfactory working condition. No owner or occupant shall cause any service, facility, equipment, or utility required in this chapter to be removed from or discontinued for any occupied dwelling or dwelling unit except for such temporary interruption as may be necessary while actual repairs, replacement, or alterations are in process.
