§ 5-112. Unbudgeted expenditures.

  • (a)

    No elected official or city employee will procure services, property or equipment and/or hire any individual, firm or company, unless money has been budgeted and it is in conformity with the budget and appropriate ordinances.

    (b)

    All requests for the procurement of nonbudgeted services, property, equipment and/or the hiring of any individual, or engaging the services of any individual, firm or company, will be presented to the city commission before such need is established. The request will be presented in writing to the city commission and will contain complete justification and set forth the need. It will be within the sole discretion of the city commission to either approve and/or reject, request additional information and/or determine the funds to be utilized if such request is approved.

    (c)

    City employees who violate this section, in addition to any other penalties described, will be subjected to immediate dismissal from employment with the city.

    (d)

    Violators of this section who are held responsible for the expenditure of appropriate funds in violation of this section will, in addition to any other penalties, be subjected to civil penalties for the recovery of expended funds.
