§ 2-121. Code prosecutor duties.

  • (a)

    The city attorney shall serve as code prosecutor.

    (b)

    The code prosecutor shall have professional discretion, including but not limited to the right to negotiate a plea with the violator, and present that plea to the special magistrate for approval, to recommend the disposition of a case to the special magistrate, and to decline to prosecute a case, similar to the discretion exercised by the state attorney in criminal cases.
