§ 2-34. Emergency ordinances.

  • (a)

    Procedure. Emergency ordinances enacted under section 3.13 "Emergency Ordinances" of the City's Charter shall be enacted by at least two-thirds ( 2/3 ) of the membership of the commission.

    (b)

    Prohibited subjects of emergency ordinances. No emergency ordinances shall be enacted that: enacts or amends the actual zoning map designation of a parcel or parcels of land; amends the actual list of permitted, conditional or prohibited uses within a zoning category; or enacts or amends a land use plan.

    (c)

    Repeal. Every emergency ordinance except emergency appropriations shall automatically stand repealed as of the 61st day following the date on which it was adopted, but this shall not prevent re-enactment of the ordinance under regular procedures, or if the emergency still exists, in the manner specified in section 3.13 of the Charter in one (1) or more increments of thirty (30) days.
