§ 15-291. Inspection and sampling.

  • (a)

    Right of entry. The control authority and authorized representatives of the city, the DEP, and the EPA bearing proper credentials have the right to enter the user's premises without prior notification to determine whether the user is complying with all requirements of this article and any wastewater discharge permit or order issued hereunder.

    Users must allow ready access to all parts of the premises for the purposes of inspection, observation, testing review and/or photocopying of records, measurement, sampling, records examination and copying, and the performance of any of the control authority's additional duties. Entry shall be made during daylight or operating hours unless abnormal or emergency circumstances require otherwise. Such authority is at least as extensive as the authority provided under F.S. § 403.091.

    (1)

    Where a user has security measures in force which require proper identification and clearance before entry into its premises, the user must make necessary arrangements with its security guards so that, upon presentation of suitable identification, the control authority, DEP, or EPA will be permitted to enter without delay for the purposes of performing specific responsibilities.

    (2)

    The control authority has the right to set up on the user's property, or require installation of, such devices as are necessary to conduct sampling and/or metering of the user's operations. Tampering with, or knowingly rendering inaccurate, such devices shall be a significant violation and could result in immediate wastewater discharge permit termination and shall place the user in significant noncompliance.

    (3)

    Any temporary or permanent obstruction to safe and easy access to the facility to be inspected and/or sampled will be promptly and permanently removed by the user at its sole expense upon the written or verbal request of the control authority.

    (4)

    Unreasonable delays by the user in allowing the control authority access to the user's premises will be deemed a violation of this article.

    (b)

    Monitoring facilities. Each industrial user shall provide and operate at its own expense a monitoring facility to allow inspection, sampling, and flow measurements of each sewer discharge to the city. Each monitoring facility shall be situated on the industrial user's premises, except where such a location would be impractical or cause undue hardship on the user, the city may concur with the facility being constructed in the public street or sidewalk area, providing that the facility is location so that it will not be obstructed by landscaping or parked vehicles. The control authority, whenever applicable, may require the construction and maintenance of sampling facilities at other locations (for example, at the end of a manufacturing line or a wastewater treatment system).

    There shall be ample room in or near such sampling facility to allow accurate sampling and preparation of samples for analysis. The facility, including the sampling and measuring equipment, shall be maintained at all times in a safe and proper operating condition at the expense of the user.

    The control authority may require the industrial user to install monitoring equipment as necessary. All monitoring facilities shall be constructed and maintained in accordance with all applicable construction standards and specifications and all devices used to measure wastewater flow and quality must be calibrated by a state certified laboratory as needed.
