§ 12-16. Rates for collection services; adjustments and amendments.

  • The rates for collection services provided on or after January 1, 2017 are set forth in subsections 12-16(a)—(f), and are subject to the conditions and limitations set forth below:

    (a)

    Rates for residential collection services:

    (1)

    Monthly rates for collection of solid waste (garbage, yard waste, and bulky waste):

    Total monthly cost (i.e., the sum of (a)(1) and (a)(2), above):

    Residential class I customers = $ 18.29 per dwelling unit

    Residential class II customers = $ 11.38 per dwelling unit

    (4)

    For residential customers, the rates for the collection of solid waste (garbage, yard waste, and bulky waste) include the collection component, the disposal component, and the franchise fee.

    (5)

    For residential customers, the disposal component of the rates for the collection of solid waste (garbage, yard waste, and bulky waste) is calculated by multiplying the applicable monthly waste generation factor by the tipping fee at the designated facility.

    (6)

    For residential customers, the monthly waste generation factors are: (i) 0.1210 tons per dwelling unit for class I customers; and (ii) 0.0420 tons per dwelling unit for class II customers.

    (7)

    If the residents of a multi-family dwelling use a mechanical container and they wish to receive collection service three (3) times each week for solid waste, the collection component of the rate for such service shall be one and one-half (1.5) times the rate that class I customers pay for collection service that is provided two (2) times per week. This will cause the total monthly cost shown in subsection 12-16(a)(3), above, for class I customers to be recalculated, and the revised total monthly cost will be multiplied by the number of dwelling units serviced by the mechanical container.

    (8)

    All monthly rates for collection services for solid waste and source separated recyclable materials from class I and class II customers are based upon the cost to both make these services available and the related provision of these services. Such rates are not based upon actual usage by any individual customer. Except as otherwise provided herein, the city's monthly rates prescribed in this subsection (a) are mandatory for all class I and class II customers, regardless of any refusal of the available services by customers.

    (3)

    The rates for commercial collection service include the collection component, disposal component, and the franchise fee.

    (4)

    For commercial customers, the disposal component of the rate for non-compacted solid waste collected in a mechanical container is based upon a weight per cubic yard factor (one hundred eighty (180) pounds per cubic yard), divided by two thousand (2,000) pounds, multiplied by the frequency of collection (pick-ups per week), multiplied by the size of the mechanical container (measured in cubic yards), multiplied by 4.33 (weeks per month), multiplied by the tipping fee.

    (5)

    For commercial customers, the disposal component of the rate for non-compacted solid waste collected in a garbage cart is based upon a weight factor (eighty-eight and one-half (88.5) pounds per (96) ninety-six-gallon garbage cart), divided by two thousand (2,000) pounds, multiplied by the number of garbage carts, multiplied by the frequency of collection (pick-ups per week), multiplied by 4.33 (weeks per month), multiplied by the tipping fee.

    (6)

    The rates for the collection of compacted solid waste in mechanical containers are the same as the rates for the collection of non-compacted (loose) solid waste in mechanical containers. However, the disposal component of the rates for compacted solid waste shall be three and one-half (3.5) times the disposal component of the rates for non-compacted solid waste.

    (c)

    Rates for collection of roll-off containers attached to compactors:

    (g)

    The city has established certain policies concerning the rates that will be charged for the collection services provided under the franchise agreement, including but not limited to the following:

    (1)

    The rates for roll-off containers attached to compactors shall be paid by commercial customers that use roll-off collection service, instead of dumpster service, and are not otherwise charged for service based on the rates for residential collection service.

    (2)

    The container rental charge for construction and demolition waste may be collected if the roll-off container is not picked up for collection for four (4) consecutive weeks.

    (3)

    The collection charge, disposal charge, and the container rental charge for roll-off containers used for the collection of construction and demolition waste also may be collected if a roll-off container is used on a temporary basis or in a manner approved by the administrator for the collection of materials other than construction and demolition waste.

    (h)

    On October 1, 2017 and annually thereafter, the collection component of the rates in subsections 12-16(a)—(e) shall be adjusted to match any increase in the city's payments to the Contractor that are based on annual changes in the CPI (collection).

    (i)

    On October 1, 2017 and annually thereafter, the disposal component of the rates in subsections 12-16(a)—(e) shall be adjusted to match any increase in the city's payments to the facilities used for the disposal of the city's solid waste that are based on annual changes in the CPI (disposal).

    (j)

    On October 1, 2018 and annually thereafter, the franchise fee shall be adjusted to match any annual increase in the CPI (collection).

    (k)

    On or before October 1, 2017 and annually thereafter, the city's public service division shall provide the city clerk with written notice of each adjustment to the city's rates that will be implemented pursuant to subsections 12-16(h)—(j). The notice shall identify each adjustment, the impact of the adjustment on the applicable components of the rates, and the new rates that will take effect on October 1.

    (l)

    Adjustments to the city's rates for collection services will be adopted by resolution of the city commission after an advertised public hearing, unless such adjustments are authorized in this section 12-16.

    (m)

    The billing rates, practices, and procedures described in this section 12-16 shall be supplemented by the provisions in the franchise agreement.
